Terms and Conditions

1. General

These terms and conditions apply when you (“you” / “the customer”) book and purchase a service (“the Service”) with Kirkenes Tours AS, either electronically (via e-mail, WhatsApp, or our website), or otherwise in writing (each a “Booking Channel”).

The agreement between you and Kirkenes Tours AS consists of:

  • the booking confirmation for the Service,
  • these general terms and conditions,
  • and any individually agreed terms in writing between you and Kirkenes Tours.

In case of any conflict, individually agreed terms shall take precedence.

When booking as a consumer, your rights are also governed by applicable Norwegian consumer protection laws.

 

2. The parties and Kirkenes Tours’ role

These terms govern the agreement between Kirkenes Tours AS and you as the customer.

Kirkenes Tours AS may use subcontractors or partner providers. In such cases, Kirkenes Tours AS remains responsible for the delivery of the Service.

If you are booking on behalf of a group, you confirm that you have the authority to enter into this agreement on behalf of all participants. You are responsible for ensuring the group is informed about and complies with these terms.

To book a service, you must be at least 18 years of age.

 

3. Bookings

You are responsible for providing accurate information when placing a booking.

The agreement becomes binding when:

  • You have placed a booking
  • You have paid for the Service
  • You have received a booking confirmation

Upon receipt, you must check that all booking details are correct. The confirmation (or any accompanying ticket/voucher) must be presented at the start of the Service.

If there are evident errors or misprints in the booking information which were or should have been obvious, Kirkenes Tours is not bound by the agreement.

By booking, you confirm that all participants meet any age or physical condition requirements related to the Service.

 

4. Prices

All prices are quoted in Norwegian kroner (NOK) and include applicable VAT.

Kirkenes Tours AS reserves the right to correct pricing errors at any time. Pricing errors that should have been obvious at the time of booking are not binding.

For corporate clients, prices may be adjusted with 60 days’ notice if changes occur due to:

  • increased supplier costs,
  • taxes or government fees,
  • currency fluctuations,
  • or force majeure conditions.

 

5. Cancellation policy

Under Norwegian law, the right of withdrawal does not apply for leisure activities, accommodation, or dining booked for a specific date or period (§22 m of the Consumer Rights Act).

Cancellations for most experiences (excluding multi-day private stays):

  • More than 21 days before the start: 100% refund
  • Between 21 and 7 days before the start: 50% refund
  • 7 days or less before the start: No refund

Custom arrangements, group bookings, or overnight stays may follow specific cancellation policies agreed upon in writing.

6. Force majeure & weather conditions

Kirkenes Tours AS cannot be held responsible if we are unable to deliver a Service due to:

  • adverse weather,
  • natural disasters,
  • strikes,
  • war or conflict,
  • government restrictions,
  • or other events beyond our control.

In case of severe weather, we may reschedule or relocate the activity. You will be informed and may cancel if the alternative is not acceptable.

 

7. Safety & insurance

All guests must follow safety instructions from guides or staff.

You are responsible for assessing your own fitness before participating in outdoor activities.

We recommend that all guests obtain personal travel insurance, including:

  • cancellation insurance,
  • accident and liability coverage,
  • winter sports coverage where applicable.

 

8. Privacy policy

By booking, you agree to the use of your personal data as described in our privacy policy.

You confirm you have permission to share data of other participants in your booking.

 

9. Liability and limitation of liability

Kirkenes Tours AS shall not be liable for loss, damage, delay, or injury unless caused by gross negligence or intent. Our liability is limited to the amount paid for the affected Service.

 

10. Complaints

Please notify us during your tour if you are dissatisfied so we can address it immediately.

Formal complaints must be sent to booking@kirkenes-tours.com within 30 days of the tour.
